1. General
The General Terms and Conditions apply to the sale and delivery of goods by our company. By clicking on the checkbox in the shopping basket before placing the order "I have read the General Terms and Conditions and expressly agree to them", the buyer agrees to these General Terms and Conditions and is bound by them. Our range of offers is non-binding. An order placed by a customer with full legal capacity (persons over the age of 18) constitutes an offer to conclude a purchase contract. The subsequent confirmation sent by us of receipt of the order within the meaning of § 10 para. 2 ECG does not in itself constitute acceptance of the offer. The purchase contract is only concluded as soon as we deliver the ordered goods, by sending a second e-mail as an order confirmation or by otherwise accepting the customer's offer. All offers on our website are subject to change, non-binding and only available while stocks last.
2. Order process, order correction, order cancellation
Once you have selected the desired product, you can place it in the shopping basket without obligation by clicking the [Add to basket] button. You can view the contents of the shopping basket at any time without obligation by clicking on the [Add to basket] button. You can remove the products from the shopping basket at any time by clicking the [Delete] button. If you wish to purchase the products in your shopping basket, click the [Checkout] button. You can then order as a guest, register a new CAJOY user account or log in with your existing account. For further orders, simply enter the login and password specified by the user during initial registration. Your data will be transmitted in encrypted form. After entering your data and selecting the type of payment and delivery, you will be taken to the order page via the [Confirm order] button, where you can check your entries again. By clicking on the button ["order with obligation to pay"] you complete the order process. You can correct your entries by clicking on the browser's "back arrow". The order process can be cancelled at any time by closing the browser. Your order represents an offer to us to conclude a purchase contract. If you have completed an order on our website using the "Buy now" button, we will send you an e-mail confirming that we have received your order (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A purchase contract is only concluded when we dispatch the ordered product to you and confirm the dispatch to you with a second e-mail (dispatch confirmation). No purchase contract is concluded for products from the same order that are not listed in the dispatch confirmation. CAJOY reserves the right not to accept the offer if an item is not available, if you have not paid invoices due to previous deliveries without authorisation, if your credit card check is not completed successfully, or if there are other justified doubts about your creditworthiness. If CAJOY is unable to fulfil an order, CAJOY will inform you as soon as possible.
3. Contract language
The content of the contract, all other information, customer service, data information and complaint handling are offered in German, English, French and Italian.
4. Prices
Prices are charged in euros or CHF (Switzerland, Liechtenstein) and per item. The prices quoted are valid at the time of the order including statutory VAT or, in Switzerland and Liechtenstein, excluding statutory VAT, plus all costs incurred in connection with shipping (costs for packaging and shipping - "shipping costs"). They are shown in the shopping basket before the contract is concluded and subsequently in a contract confirmation sent to the customer. Should export or import duties become due in the course of dispatch to Switzerland or Liechtenstein, these shall be borne by CAJOY within the framework of the DDP delivery terms. In the event of typing, printing and calculation errors on the website, CAJOY shall be entitled to withdraw from the contract or prepare an amended offer, whereby the customer shall be free to accept this.
5. Right of cancellation for consumers
Consumers under the Austrian Consumer Protection Act (KSchG) have the right to cancel this contract within fourteen days of placing an online order without giving a reason. For purchases made in one of our boutiques, we offer a voluntary exchange policy for unworn jewelry within 7 days of the purchase date with proof of purchase. Alternatively, we are happy to issue a credit note, but unfortunately, a full refund of the purchase price is not possible.
The withdrawal period for online orders is:
1. in the case of a purchase contract, fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
2. in the case of a contract for several goods which you have ordered as part of a single order and which are delivered separately, fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
3. in the case of a contract for the delivery of goods in several partial shipments or pieces, fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last partial shipment or the last piece.
To exercise the right of cancellation, you must inform CAJOY GmbH (Inkustraße 1-7/Haus 1, 3400 Klosterneuburg, info@cajoy.com) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, e-mail). To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.
Consequences of cancellation
If you revoke this contract in part, CAJOY shall refund the payments for the goods returned by you immediately and at the latest within fourteen days from the day on which CAJOY received the returned goods. If you revoke this contract in its entirety, CAJOY shall refund the payments for the goods returned by you, as well as any standard shipping costs paid, immediately and at the latest within fourteen days from the day on which the returned goods are received by CAJOY.
For this repayment, CAJOY will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. CAJOY may refuse the refund until the goods have been properly returned. Consumers must return or hand over the goods to CAJOY immediately and in any case within fourteen days at the latest from the day on which you informed CAJOY of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

CAJOY will send you a return label for the return of the goods on request and will charge € 5.90 for the return shipment from Austria and Germany. For all other EU countries, an amount of € 9.90 will be charged for the return shipment. Returns from Switzerland and Liechtenstein with a FedEx return label will be charged at CHF 9.90. You can also drop off the package at one of our stores or return it to us yourself using a shipping service provider of your choice; of course, there are no return shipping fees. Please note: if additional costs or customs duties are incurred during delivery as a result of you returning the goods yourself, we will unfortunately have to charge you for these.
Notes for the smoothest possible processing of returns
If you would like to return an item, please contact CAJOY via the contact form or via info@cajoy.com and you will receive a return slip. Please send the item complete and, if possible, in the original packaging, including a brief description of the reason for the return. The use of the original packaging is not a "must", i.e. not a prerequisite for asserting your rights, but simplifies and secures the processing. After prior notification, you can also return items from different orders in one return shipment.
Please note that customised items cannot be returned.
6. Payment
We accept the following payment methods:
- Credit card (VISA, MasterCard, Diners)
Payment by credit card will be charged on the same day. When paying by credit card, the customer must provide the following data: Card holder, card number, credit card company, expiry date, CVV code. The data is transmitted using SSL encryption with a minimum 128-bit key and is therefore not visible to unauthorised persons.

In co-operation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we also offer the payment option "Invoice". Payment is made to Klarna. The use of the invoice payment method requires a positive credit check. In this respect, we forward your data to Klarna for the purpose of address and credit checks as part of the purchase initiation and processing of the purchase contract. Please understand that we can only offer you those payment methods that are permitted based on the results of the credit check. Further information and Klarna's terms of use can be found here. Your personal data will be treated by Klarna in accordance with the applicable data protection regulations and in accordance with the information in Klarna's privacy policy.
If the contract is not concluded or is cancelled, any purchase price already paid will be refunded. Repayment shall be made by the same method of payment - by immediate bank transfer to the account used, by credit card or Paypal to the same credit card or Paypal account.
7. Default of payment
If the customer is in default of payment, CAJOY shall be entitled to demand the statutory default interest and any operating costs incurred.
8. Reminder and collection charges
In the event of default, the customer undertakes to reimburse CAJOY for the dunning and collection expenses to which CAJOY is entitled, even in the event of default in payment through no fault of its own, insofar as they are necessary for appropriate legal prosecution and are reasonable in relation to the claim, whereby the customer undertakes in particular to reimburse us for the costs incurred by us in the event of the involvement of a collection agency, insofar as these do not exceed the maximum rates of remuneration due to collection agencies. If CAJOY handles the dunning process itself, the debtor undertakes to pay an amount of €12 or CHF 15 per reminder and an amount of €5 or CHF 8 per half-year for keeping the debt relationship on record in the dunning process.
9. Default of acceptance
In the event of default of acceptance by customers who have ordered as entrepreneurs, CAJOY shall be entitled to store the goods, for which CAJOY shall charge a storage fee of €10 or CHF 15 per calendar day or part thereof. At the same time CAJOY insists on fulfilment of the contract.
10. Retention of title
CAJOY retains ownership of the delivered goods until all payments from the business relationship with the customer have been received. If the customer resells goods subject to retention of title, he shall also pass on the retention of title. The customer shall immediately notify CAJOY of any access by third parties to the goods subject to retention of title. Pledges, transfers by way of security and similar of the goods subject to retention of title are only permitted with the prior consent of CAJOY. If payment is not made immediately after a reminder, the goods subject to retention of title shall be returned to CAJOY without delay. The return costs shall be borne by the customer.

12. Warranty, liability, guarantee
Aspart of the 6-month CAJOY warranty, we will repair or replace defective goods at our own expense.
The warranty is based on the statutory provisions of the European Union. It is limited to the statutory period of 24 months from acceptance of the goods by the buyer. In the event of justified complaints about defects, either a replacement or improvement shall be made free of charge, for which a reasonable period of time shall be granted. If replacement or improvement is out of the question (not possible, excessive expense, unreasonable, delay, etc.), the buyer shall be entitled to a price reduction or, if the defect is not minor, cancellation of the contract (rescission). Defects that occur must be reported as soon as possible upon delivery or after they become visible, whereby failure to report them upon delivery or after they become visible by a consumer shall have no influence on the consumer's warranty claims.
CAJOY shall only be liable for damages caused by intent and gross negligence. This does not apply to personal injury or consumer transactions. The existence of slight or gross negligence must be proven by the injured party, unless it is a consumer transaction. Compensation for consequential (defect) damage, as well as other property damage, financial loss and damage to third parties against the customer, unless it is a consumer transaction, is excluded.
When goods are dispatched in consumer transactions, the risk of loss or damage to the goods shall only pass to the consumer as soon as the goods are delivered to the consumer or to a third party designated by the consumer and other than the carrier. However, if the consumer has concluded the contract of carriage himself without making use of a selection option proposed by us, the risk is transferred to the carrier as soon as the goods are handed over.
Please note: CAJOY only offers goods made by hand, often using natural materials such as pearls or precious stones. The product images may therefore differ slightly from the appearance of the delivered goods, in particular with regard to colour, structure and size. Claims for defects do not exist insofar as the changes are reasonable for the customer. The customer is aware that when ordering via the Internet, the colour representation of the goods may deviate from the actual colour due to the type and quality of his technical equipment and that this does not constitute a warranty obligation. Jewellery may itself show signs of wear in the form of scratches, nicks, dents or abrasions through normal use, none of which constitute a defect and are not subject to this warranty obligation. Also excluded from the warranty are damages that are due to natural wear and tear, improper use, overuse and lack of or incorrect care or storage. You can only claim obvious defects in the delivered goods or incorrect deliveries if you notify us of these in text form within one month of delivery with a precise description. The dispatch of the notice of defects is decisive for the timeliness. Otherwise, the warranty period is two years and begins with the handover of the goods to you. If the goods are obviously defective, we shall provide subsequent fulfilment within a reasonable period of time, i.e. either a replacement delivery or rectification of the defects, provided that you are a consumer.
13. Applicable law, place of jurisdiction
The contracting parties agree that Austrian law shall apply. If the consumer is domiciled or habitually resident in Austria or is employed in Austria, only the court in whose district the domicile, habitual residence or place of employment is located shall have jurisdiction to hear an action against the consumer; this shall not apply to legal disputes that have already arisen. The UN Convention on Contracts for the International Sale of Goods and all provisions relating to the UN Convention on Contracts for the International Sale of Goods are expressly excluded. For contracts with companies, our registered office is agreed as the place of jurisdiction.
14. Place of fulfilment for business transactions
The place of fulfilment for all services arising from the contract is our registered office.

All news, graphics and the design of our website are exclusively for the personal information of our customers and are protected by copyright.
16. Arbitration centre
We undertake to participate in the arbitration procedure of the Internet Ombudsman's Office in the event of disputes: www.ombudsstelle.at. 17. Delivery
CAJOY delivers worldwide. Unless otherwise agreed, delivery shall be made from CAJOY's warehouse to the delivery address specified by the customer. You will find information on the availability of the individual products on the website. They do not constitute binding or guaranteed dispatch or delivery dates, unless this is expressly indicated as a binding date in the dispatch options of the respective product. If CAJOY realises during the processing of your order that the products you have ordered are not available, you will be informed separately by e-mail.
The delivery time is usually 1 to 3 days from the date of order. Delivery is made by GLS, Post, Fedex or DHL. As soon as our delivery is on its way, you will receive a link to the shipment tracking by e-mail. CAJOY reserves the right to charge the costs incurred for the delivery as well as the costs of return transport for shipments that are refused or not collected. Non-acceptance/non-collection shall in no case constitute a cancellation, as this is not expressly declared.
18. Shipping costs
Standard shipping within Austria costs € 4.90, within Germany € 5.90. For customers based in other EU countries, shipping costs € 9.90. From a basket value of € 90, delivery is free of shipping costs within Austria and Germany.
From a basket value of € 150, delivery is free of shipping costs to other EU countries (all amounts include 20% VAT). Delivery to Switzerland and Liechtenstein costs CHF 7.90 as standard and is DDP. Standard delivery is free of charge for orders over CHF 150.
19. Notification of transport damage
If items are delivered with obvious damage to the packaging or contents, the customer must immediately complain about this to the shipping company without prejudice to his warranty rights and immediately send an e-mail to CAJOY or contact CAJOY in any other way so that CAJOY can protect any rights against the shipping company. We will inform you immediately about the further procedure. Please do not return any goods without prior clarification! Unpaid and unauthorised consignments cannot be accepted.
20. Gift vouchers
Cash payment of online gift vouchers or other vouchers is not possible.
21. Storage of the contract
Your order will be stored by us and can be requested by you or accessed in your customer account after completion of the order process. You will receive the order data as an order confirmation immediately after submitting your order and can print it out.
22. Complaints / enquiries
We attach great importance to customer service and endeavour to process your request as quickly as possible. As a rule, all enquiries are answered within 2 working days.
23. Miscellaneous
Recourse claims within the meaning of the Product Liability Act are excluded, unless the party entitled to recourse proves that the defect was caused in our sphere and was at least due to gross negligence. The contractual partner waives the possibility of offsetting. However, this does not apply to consumers.
